Financial Regulatory Law Practice Group – Strategic. Experienced. Solution-oriented. We provide comprehensive advice to financial institutions and fintech companies on all regulatory issues – from business models not requiring authorization under the German Electronic Money Act (ZAG) and German Banking Act (KWG) to authorization procedures, owner controls, compliance investigations, and enforcement proceedings at BaFin and the ECB.
Our Financial Regulatory Law Practice Group supports financial market participants in the legal structuring of innovative business models and guides them through complex regulatory processes. This includes, among other things, the regulatory assessment of business activities (in particular with regard to licensing requirements), the implementation of licensing and registration procedures, and advice on the structuring of business models in the payment and e-money, credit, and fund sectors. We assist our clients in shareholder control proceedings, analyze the applicability of sector exemptions, and represent executives in proceedings with national and European supervisory authorities. In addition, we conduct practice-oriented audits to ensure compliance with regulatory requirements and have in-depth knowledge of the requirements of BaFin and the ECB.
