SZA Schilling, Zutt & Anschütz successful again for Sisvel in the Appeal filed by Institut für Rundfunktechnik GmbH (IRT) before the Higher Regional Court of Karlsruhe

Press Release Litigation & Arbitration Intellectual Property -

A team of SZA Schilling, Zutt & Anschütz led by Prof. Dr. Jochem Reichert, Dr. Thomas Nägele and Dr. Marc Löbbe successfully defended the Italian patent pool administrator Società Italiana per le Sviluppo dell' Elettronica, S.I.SV.EL., S.p.A. (Sisvel) again in the appeal proceedings be-fore the Higher Regional Court of Karlsruhe, in which IRT was essentially seeking for the payment of several million Euros. Sisvel had already been successful in the first instance before the Mannheim Regional Court with SZA Schilling, Zutt & An-schütz (

Sisvel took over patent monetization for IRT from 1996 to 2017 in return for an agreed lump-sum fee, which was adjusted several times over the years. This included patents that Sisvel exploited in a patent pool for MPEG audio technology. Sisvel succeeded in enforcing licenses for this pool also against users of MP3 technology.

The Karlsruhe Higher Regional Court did not follow IRT’s reasoning and dismissed the appeal in full on November 9, 2022 (case no. 6 U 131/19). Revision on points of law was not admitted.

The Schilling, Zutt & Anschütz team consisted of Prof. Dr. Jochem Reichert (Corporate/ Dispute Resolution, Mannheim), Dr. Thomas Nägele (IP/IT/Dispute Resolution, Mannheim), Dr. Marc Löbbe (Corporate Dispute Resolution, Frankfurt) (respectively acting as leading coordinators) as well as Dr. Simon Apel (IP/IT/ Dispute Resolution, Mannheim), and Dr. Jakob Groh, LL.M. (Northwestern) (Corporate/ Dispute Resolution, Mannheim).
