Volkswagen AG with SZA Schilling, Zutt & Anschütz and Porsche Automobil Holding SE with Hengeler Mueller reach recusal of the judge dealing with the Stuttgart diesel investor claims

Volkswagen and PSE's motion to recuse was finally successful. Volkswagen, represented by SZA Schilling, Zutt & Anschütz, had already expressed doubts in the beginning of 2018 concerning the impartiality of the judge who was involved in the Stuttgart diesel investor claims.

A first motion was then refused by the Higher Regional Court (OLG) Stuttgart. 
The latest motion, however, was approved by the Regional Court (LG) based on  the fact that the judge's wife was an owner of a concerned diesel vehicle and had filed a suit against Volkswagen to reverse the purchase of the vehicle in the end of 2018.
